Assistant Professor Dr. Abbas Samir, a professor of civil law at our college, participated in the committee to discuss a master’s thesis on the provisions of deception in the marriage contract in Iraqi law – a comparative study in Islamic jurisprudence, submitted by the student Ghraa Abdul Rasoul Al-Salami.

The study aimed to define the meaning of deception in the marriage contract, and to clarify its distinction from others, especially in light of its similarity to many terms, and to know the position of the law on it, in addition to clarifying the position of Islamic jurisprudence on deception amidst the jurisprudential differences in determining its cases and effects.

The study concluded that deception affects the validity of consent, but does not lead to its complete absence, and it is required to achieve change in the marriage contract that the deception be issued by one of the parties to the contract, while there is no explicit definition of the term deception in Iraqi law or in Islamic jurisprudence.
